These Terms of Service (“Terms”) govern your use of the Lottraq website and services (the “Platform”), operated by Lottraq Ghana Limited (“Lottraq”, “we”, “us”). You accept them when you create an account, and again when you make or accept an offer. We record which version you accepted.
Our Privacy Policy explains how we handle your personal data. If you do not agree to these Terms, please do not use the Platform.
Lottraq is an online marketplace for vehicles in Ghana. It lets dealers and private sellers list vehicles, and lets buyers search, save, enquire and make offers. We also provide dealer tools such as listings, inventory, customer management, messaging and a dealer website.
Some services you may see on the Platform are marked “Soon”, for example vehicle financing applications, escrow, SMS and WhatsApp messaging, and accounts for importers, rentals and service providers. They are not available yet, and these Terms do not cover them until they are.
We are a platform, not the seller. We do not own or inspect the vehicles listed, and we are not a party to any sale agreement. The contract for a vehicle is between the buyer and the seller.
Who can use Lottraq. You must be 18 or older, and able to enter a binding contract under Ghanaian law, to create an account or use the Platform. By creating an account you confirm that you are. We may close an account held by someone under 18. Give accurate information and keep it up to date. Keep your password secret. You are responsible for activity on your account, so tell us straight away if you think someone else has used it.
A dealer account belongs to the business. The person who sets it up confirms they are authorised to act for that business, and is responsible for the team members they invite.
Dealers are responsible for the information they record about their own customers on the Platform, such as leads, trade-ins and test drives, including any driving licence details. Collect only what you need, tell your customers why, and keep it accurate. Lottraq stores that information for you and does not use it for its own purposes.
If you list a vehicle, you confirm that:
If you use our AI tools to help write a listing or tag photos, check the result before you publish. You are responsible for the listing either way.
We may review a listing before or after it goes live. We may hide or remove it if it breaks these Terms. When a vehicle sells, its listing may stay visible for a few days marked “Sold”. A sold vehicle cannot be bought through the Platform.
Enquiries. When you send an enquiry, we pass your details and message to the seller so they can reply. Use them only for genuine vehicle enquiries.
Offers. A buyer can make an offer on a listing, and the seller can accept, decline or counter it. Each offer expires at the time shown on it. When a seller accepts, the listing is marked as under offer, other open offers on it are closed, and we record what was agreed: the vehicle as listed, the price and the version of these Terms. Both sides agree to go ahead with the deal in good faith. Completing the sale (inspection, payment, paperwork, handover) is arranged between the two of you.
Cash offers. A seller can ask verified dealers for cash offers on a vehicle. Dealers see the vehicle and how their own offer compares, but never other dealers’ amounts. The seller does not have to accept any offer.
Lottraq does not take, hold or escrow payment for vehicles. You pay the seller directly, off the Platform. Before you pay, check the vehicle and its documents yourself. We recommend an independent inspection and checking the registration papers with the DVLA.
Any finance or monthly-payment figures on the Platform are estimates for guidance. They are not a loan offer.
Payments are processed by our payment processor. Prices are in Ghana cedis and are shown before you pay. We may change prices, but a change never affects something you have already paid for.
If a paid service is not delivered because of a fault on our side, tell us and we will put it right or refund you. Otherwise, fees are not refundable once the service has been delivered (for example, a report has been unlocked or a boost has started), except where Ghanaian law requires a refund.
Dealer verification means we checked certain documents at a point in time. It is not a guarantee of the dealer, a vehicle or a deal. Trust scores are calculated from Platform activity and can change. Reviews must be honest and based on a real experience. Dealers may reply publicly. We may remove reviews that break these Terms.
You must not:
If you break these Terms, or we reasonably suspect fraud or a risk to other users, we may remove content, limit features, or suspend or close your account. Where we can, we will tell you why, and you can ask us to reconsider. We may also act where the law or an authority requires it.
You can delete your account at any time from your profile or dealer settings, unless you still have open obligations (for example, a listing under offer or an open dispute). The owner of a dealer account closes the business account by emailing [email protected]. The Privacy Policy explains what happens to your data.
You keep ownership of the photos, descriptions and other content you upload. You give Lottraq a non-exclusive, royalty-free licence to host, display, resize and promote that content on the Platform for as long as it is listed, and for the records we must keep. Only upload content you have the right to use. The Platform itself (its software, design and the Lottraq name and logo) belongs to Lottraq.
We work to keep the Platform accurate and available, but we provide it “as is”. We do not guarantee it will be uninterrupted or error-free. We do not guarantee any vehicle, listing, seller, buyer or deal. Nothing in these Terms takes away rights you have under Ghanaian law that cannot be excluded.
As far as the law allows, Lottraq is not liable for:
Otherwise, our total liability to you is limited to the amount you paid Lottraq in the 12 months before the claim. Nothing here limits liability for death or personal injury caused by our negligence, for fraud, or any other liability the law does not allow us to limit.
You agree to cover Lottraq’s reasonable losses arising from your breach of these Terms or from content you post.
These Terms are governed by the laws of the Republic of Ghana, and the courts of Ghana have jurisdiction. Please contact us first at [email protected] so we can try to resolve the issue informally.
We may update these Terms. When a change is material, we publish a new version with a new date and version number above and take reasonable steps to tell you. The version you accepted continues to apply to offers you made or accepted under it. If you keep using the Platform after a change takes effect, you accept the new Terms.
